An Altavista police officer has been cleared of any criminal wrongdoing after he shot and killed an 83-year-old woman last September.
Roanoke's commonwealth's attorney, Don Caldwell, said in a written report that Altavista police sergeant L.P. Rigney, Jr. had the right to defend himself after Delma Towler pointed a gun at him on the night of Sept. 19, 2012.
After numerous attempts to get Towler to answer her door when officers got there, Caldwell said, Towler fired several rounds inside her home and at police.
Police were there after a 911 hang-up came from the home.
Towler was outside trying to get to the home of nearby family member when Caldwell said evidence and video from lapel cameras the officers were wearing showed Towler failing to obey commands to put her gun down and eventually aiming it at Rigney.
Rigney has been on paid administrative leave ever since.
Altavista Town Manager Waverly Coggsdale said it is anticipated Rigney will return to full duty soon.
